Section 1001.42(4)(f), F.S., regarding the responsibility of district school boards to set school start dates was amended this past legislative session. Prior to this change, this section of law required school boards to “Adopt policies for the opening and closing of schools and fix uniform dates.” The new requirement provides that school boards shall “Adopt policies for the opening and closing of schools and fix uniform dates; however, beginning with the 2007-2008 school year, the opening date for schools in the district may not be earlier than 14 days before Labor Day each year.”

2. Are the 14 days before Labor Day calendar days or business days?
The law provides that “beginning with the 2007-2008 school year, the opening date for schools in the district may not be earlier than 14 days before Labor Day each year.” This is calendar days, since “business days” is not stipulated.
